Q: What is domestic violence?

A: Under Ohio law, “domestic violence” includes any act or threat of physical harm committed against a spouse, former spouse, domestic partner, or another household member. In most cases, this includes:

  • Your parent
  • Your sibling
  • Your child or grandchild
  • The parent of your children

Q: How can I get help for domestic violence?

A: If you or a member of your household is a victim of domestic violence, you should try to get to safety and then call 911. When you contact us, our attorneys will take all action necessary to protect you and your loved ones. This includes filing for a protection order in court.

Q: What does a protection order do?

A: In Ohio, a protection order (formally referred to as a “Domestic Violence Civil Protection Order”) prohibits an abuser or violent household member from committing further acts of violence. Protection orders can last for up to five years, and individuals who violate protection orders can face serious criminal charges.

Q: Should I file for a Domestic Violence Civil Protection Order?

A: In most cases, yes, if you are a victim of domestic violence, you should absolutely seek a protection order. In order to make sure you are protected, we strongly recommend that you hire an attorney to file the Petition for Domestic Violence Civil Protection Order on your behalf.

Q: Can I seek a protection order on someone else’s behalf?

A: Yes. There are limits on who can file, but generally speaking, you can seek a protection order on behalf of any member of your household. You can also seek a protection order for:

  • Relatives by blood or marriage with whom you have lived at any point in time
  • Anyone you have lived with at any point in the last five years
  • A former spouse
  • Your child’s other parent

Q: Can I protect my pets as well as my family members?

A: Yes, thanks to an Ohio law passed in 2014, protection orders can now include provisions for the safety of domestic violence victims’ pets.

Q: How soon can I get a Domestic Violence Civil Protection Order?

A: Emergency protection orders can be granted the same day. Then, a full hearing will be scheduled within seven to 10 days.
